Council Candidate forum
City Council Update:
The CBA hosted a forum and invited all of the candidates to
come speak and take questions on Wednesday January 11, 7 PM at the Beach
Recreation Center. Turn out was about 65 folks.
And then the election took place on January 31, 2012
New council comes to Clearwater: On February
13th the City of Clearwater will get a new mayor and two new
city council members. George Cretekos will
become our new mayor and Doreen DiPolito and
Jay Polglaze will become our newest council
members and will join Bill Jonson and
Paul Gibson on the dais. Clearwater voters rejected
referendum items that would have extended council member term
limits from two to three terms and increasing the scheduling
time of when the Charter Review Committee meets. The citizens
did approve the referendum item requiring the city to publicize
when its annual audit will be released.
Thank you Mayor Frank Hibbard and Council
Member John Doran for serving the citizens of
Clearwater. Best wishes and congratulations to Clearwater's new
mayor and council members, and the seasoned ones too!
Family Fun Fest fund raiser
Tampa Bay Harvest,
Clearwater Beach Association and the city of Clearwater
sponsored the first annual Family Fun Fest on Clearwater Beach,
Saturday October 24 and Sunday October 25.

The 2 day event featured: arts, crafts, entertainment, food,
and beverages with a focus on the entire family. For detailed
information on participating, volunteering, sponsorship, and
just coming out and having fun, visit the web site at

Friends of Clearwater Beach Recreation Center/Library
A non
profit group of
volunteers that was formed in 2007 to save the Beach Recreation
Center and Library.
The mission of the
group is to support programs that will increase the utilization
of the
Beach
Recreation Center
and Library. Recently the
"Friends ..." purchased a flat screen TV and Wii system for the
center.
The city responded by consolidating
the library into the Recreation Center building on Bay
Esplanade. The new Beach library opened in spring
2008.
The Recreation Center has since been renovated and includes a
new state of art exercise room.
The group meets on the second
Thursday of each
month, 6:00 - 8:00 PM, at the Beach Recreation
Center.
Folks are welcome to come and share ideas and or
volunteer
to help achieve the mission.

Quarter 2008
...Clearwater's
home of the first quarter 2008 is right here on the Beach!The home of Ray and Gerda Massieu at 817 Bruce

was number uno for the quarter. Congratulations to Ray and
Gerda for deciding to build here on the Beach in the late 1990s.
First quarter, 2007
... The home of Ross and Florence
on Bruce was built in the late 1940's. Ross and
Florence redesigned the house, added all kind of things and
came in number one for the quarter. Congratulations to
Ross and Flo. Wonder who did all the work ... Ross or
Flo?
North Clearwater Beach -
Neighborhood of the quarter, Summer 2010
Sue Johnson,
president of the CBA accepted the Neighborhood of the Quarter
award at the September 2010 City Council meeting. She
explained that the award reflects the council thinking the CBA
for its contributions towards making the city a great place to
live, work, and play.

Sandy Britton was
crowned Mrs. Clearwater Beach on September 8, 2007 at the Hilton
Hotel.
 
Sandy
was selected by the Clinique for Aesthetic and Natural Denistry
of Jonathan J. Bromboz DDS PA for this prestigious honor.
The picture on the left is with her husband, Jack and dear
friend, Raye ... the
picture on the right are a few of her supporters. Sandy was chosen for her outstanding contribution to the
community of Clearwater Beach. Sandy and her family have
been residents of the beach since 1995 ... and have been
involved in many activities which have contributed to improving
the community since moving here. Congratulations Sandy!

CAN ... Clearwater
Awards for Neighborhoods, sponsored by the city of
Clearwater.
Two years in a row ...
The CBA and its
members have done some good things
...On October 11, 2008 the Neighborhood
Services Group sponsored the CAN picnic and presented the
awards for 2008. The CBA received 2 awards,
Most Attendance at City
meetings/Training ... and second
place for the Mayor's
Award of Excellence.
A very special thank you
to all the CBA volunteers who made winning the awards
possible...job well done!
There were 255 CBA volunteering activities that resulted in
over 10,000 hours helping to improve the quality of life
some where in Clearwater over the last year. Check out the
CAN web site for more details.

CBA
and the Clearwater Community Sailing
Center's 2nd annual Golf Tournament.
Was Played
at East Lake Woodlands Country Club on October 29,
2007 .... There were 88 players supported by 20 plus
volunteers. CBA's share of the
proceeds in 2006 and 2007 will go to support food gathering
activities with Tampa Bay Harvest. There was no golf tournament for 2008, hope to get
it cranked buck up in 2009.
Short Term Rentals ...
A brief history in time!
Summary Judgment Hearing on January 18, 2006... Albrittion vs
City of Clearwater, was conducted by the Honorable Judge Khouzam. On February 1,
2006 Judge Khouzam denied the city's motion for dismissal.
In
late March 2006 the Judge ordered
both parties into mediation ... The first mediation session
took place on May 25, 2006 ... Mediator Ferguson thought
progress had taken place so he extended the mediation
process for another 45 days. 7/7/2006, the
mediation process failed ...
so, in early
September 2006 Judge Khouzam set
the trial date for February 2007.
November 29, 2006
the court held a hearing and ruled that
neighborhood complaints about short term rentals would not
be admitted. A status conference will take place on
January 18, 2007 with both parties and then trial dates will
be set!
The
parties got together on January 18th and the trial date set for April 3 beginning at 10:00
a.m. The courtroom will be one of those adjacent to
Judge Khouzam's chambers.
The trial started and ended on April 3, 2007. Judge Khouzam aims to have a ruling
around mid April, 2007.
On April 20, 2007 the Judge publisher her ruling. The court found
that neither the 1980 nor the 1999 city codes prohibited
short-term rentals in that they did not provide sufficient
notice to the public that this particular use was
prohibited. She also found that all of the plaintiffs'
properties were offered for use as short-term rentals prior
to the adoption of the 2003 ordinance. Therefore she
found that the short-term rental uses on the 31 listed
properties are established nonconforming lawful uses
entitled to grandfather status. She did find that the
"continued nonconforming use must comply with the terms set
forth in the applicable City Code", in other words,
they may not be expanded, etc.
On May 3, 2007 the City Council voted
5 to 0 to appeal the ruling ... so the appeal process is
underway.
The brief filing process started in
July 2007 and concluded in September. The trial date was set
for November 28, 2007 ... to take place at the Courthouse in
Lakeland beginning at 9:30 AM. Each side will be given
20 minutes to argue their case ... then a written opinion
from the court of appeals normally takes a couple of
months.
December 11, 2007 ... The Second
District Court of Appeals has upheld the decision of the Circuit
Court. The 31 listed properties continue short term
rentals.
And now some more of the story:
April 2008 ... The
legal department grants non conforming status to 779 Eldorado.
Now 32 STR properties.
April 2010 ... 735 Eldorado goes through the
administrative process and is granted non conforming status ...
now 33 STR properties.
June 2010 ... 172
Devon, 976 Mandalay, and 1044 Bay Esplanade successfully sues
the city and is granted non conforming status ... now 36 STR
properties.
June 2010 ... 831 Eldorado notified by the
community Development Coordinator that he had lost nonconformity
status by virtue of discontinuance for a period of six months
... now 35 STR properties.
July 2012 ... 831 Eldorado filed a civil complaint
and in July 2012 the court reinstated the non conforming status.
So again there are 36 STR properties.
